Terms of Service

These terms govern access to and use of the Kultara website, iOS application and related services.

1. Agreement to these terms

By accessing or using Kultara, you agree to these Terms of Service and the policies referenced here. If you do not agree, do not use the service.

2. The Kultara service

Kultara provides immersive sound journeys, sound-layer creation tools, selected visual art and related listening experiences. Features may change as the product develops, including during beta periods.

3. Eligibility and accounts

You may use Kultara only if you are legally permitted to enter into these terms where you live. Core V1 use is not intended to require a mandatory account. If you create or use an account, you are responsible for keeping access credentials secure and for activity under that account.

4. Acceptable use

You may not misuse the service, interfere with its operation, attempt unauthorized access, bypass usage restrictions, extract protected content at scale, or use Kultara in violation of applicable law or third-party rights.

5. Intellectual property

Kultara’s software, branding, sound recordings, compositions, artwork, text, design and other content may be protected by copyright, trademark and other intellectual-property rights. Access to Kultara does not transfer ownership of that material.

Consumer access is for personal use unless separate professional-use rights are expressly granted. See Professional Terms.

6. Subscriptions and purchases

Paid access may be offered through auto-renewable subscriptions or other purchases. The price, billing period and trial terms shown in the applicable purchase interface control. See Subscription Terms and Refunds.

7. Third-party platforms

When you download Kultara or purchase through Apple, Apple’s applicable terms, payment rules and platform policies also apply to that transaction and platform relationship.

8. Beta and service changes

Beta features may be incomplete, changed or removed. Kultara may modify, suspend or discontinue features when reasonably necessary for product, security, legal or operational reasons.

9. No medical service

Kultara is a sound and cultural experience. It is not presented as medical care, diagnosis, treatment, therapy or a substitute for professional health advice.

10. Disclaimers

To the extent permitted by applicable law, the service is provided on an “as available” basis. Kultara does not promise that every feature will be uninterrupted, error-free or available on every device or network.

11. Limitation of liability

To the extent permitted by applicable law, Kultara is not responsible for indirect, incidental, special, consequential or punitive damages arising from use of the service. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

12. Privacy

Use of personal information is described in the Privacy Policy.

13. Changes to these terms

These terms may be updated as the service changes or legal requirements evolve. The updated date will be shown on this page, and material changes may be communicated through the service where appropriate.

The final production version must identify the service operator and any governing-law or dispute terms only after those facts are formally confirmed.
